 ctive abortions are legally sanctioned in most of the world. However\, thi
 s\nunproblematic legal order is rendered questionable by the new rights pa
 radigm\nbrought by the UN Convention on the Rights for Persons with Disabi
 lities (UNCRPD).&nbsp\;&nbsp\; The UNCRPD necessitates all social\ninstitu
 tions to adhere to an equal rights paradigm. India has both signed and\nra
 tified the Convention.&nbsp\;&nbsp\; However\, the\nSupreme Court of India
  has adjudicated disability selective termination for the\none fetus with 
 disability while preferring the other without disability in a\ntwin pregna
 ncy in Komal Hiwale’s case.\nThe apex court in its construction of a sophi
 sticated term\, “selective fetal\nreduction” has permitted preference for 
 life without disability. This talk will\nexplore the issues around the rig
 ht of equality and non-discrimination affirmed\nby the UNCRPD and the cons
 equent domestic laws instituted in India.&nbsp\;Smitha Nizar\nFulbright Po
 st-Doctoral Visiting Scholar\nSyracuse University&nbsp\; College of LawSmi
 tha Nizar is a\nFulbright Post-Doctoral Visiting Scholar from India. In he
 r post-doctoral\nresearch\, she examines the need to align India’s nationa
 l laws with the United\nNations’ Convention on the Rights of Persons with 
 Disabilities (UNCRPD) and to\nuphold the basic rights for persons with dis
 abilities.&nbsp\; Her previous study\, The Contradiction in\nDisability La
 w:&nbsp\; Selective Abortions and\nRights (Oxford University Press\, 2016)
 \, has highlighted the contradicting\nlegal order on disability-selective 
 abortion which is discriminatory and in violation\nof the international la
 w. Dr. Nizar’s study also reveals how\ndisability-selective abortion is in
 consistent with the UNCRPD and its\nlife-affirming paradigm. This research
  will benefit India and the United States\nby urging the respective law ma
 kers to revisit the specific laws. Prior to her\nresearch visit to Syracus
 e\, Dr. Nizar was teaching and practicing law in\nIndia.&nbsp\; She volunt
 eers her time as the\nLegal Officer of a disability rehabilitation organiz
 ation\, where children with\ndisabilities are supported and educated from 
 the very early stages of life. She\ndreams for a world where disability is
