Waiver, Consent and Release
On behalf of myself (if 18+ years of age) or my minor child, I hereby:
- acknowledge that there are inherent risks and dangers involved in participating in the Orange Works program (the “Program”), including without limitation risk of bodily injury, illness or death, and accept and assume all risks
and dangers of participation in the Program (whether foreseeable or unforeseeable);
- give Syracuse University (the “University”) and anyone acting on its behalf or authorized by the University permission to take video footage, audio footage and photographs of me (or my minor child) in connection with the Program and use
such photographs and footage, as well as my (or my minor child’s) name, image/likeness, voice recording and biographical information, for any promotional, public relations/media or other purposes related to the Program, including without
limitation in internal and external digital or print publications, social media posts, and University and non-University websites (each, a “Permitted Use”) without compensation to me (or my minor child);
- waive any right to review or approve of any photographs, footage or Permitted Use;
- agree to abide by all policies, rules and restrictions applicable to the Program;
- represent that I (or my minor child) have adequate medical or health insurance to cover any medical assistance that I (or my minor child) may require if any portion of the Program is on the University’s campus, and give the University permission
to seek or provide medical treatment should the need arise and my (or my minor child’s) emergency contact cannot be reached;
- waive, release, discharge and covenant not to sue the University or its trustees, officers, directors, employees, agents, contractors and representatives (each, a “Released Party”) with respect to any and all claims, causes of action,
demands and liabilities arising out of or related to a Permitted Use or my (or my minor child’s) participation in the Program, including without limitation claims related to rights of privacy or publicity, bodily injury, illness or death,
or damage to or loss of personal property, and any liability for damages or the payment of any royalties, unless caused by the gross negligence or willful misconduct of a Released Party;
- acknowledge and agree that this Waiver, Consent and Release is entered into voluntarily by me and is irrevocable and binding upon me (and my minor child) and my (and my minor child’s) heirs, executors, administrators, legal representatives and
assigns; and
- consent to sign this Waiver, Consent and Release electronically and agree that any such electronic signature shall have the same legal and evidentiary effect as a handwritten signature.
This Waiver, Consent and Release is intended to be as broad and inclusive as is permitted by the laws of the State of New York. If any portion of this waiver is held invalid, the invalid portion shall be modified by a court of competent jurisdiction
to be enforceable to the fullest extent permitted by applicable law and the remaining terms shall continue in full force and effect.
